Boulder’s ADU guidance states that owner occupancy is no longer required as of March 8, 2025, following state legislation. That change concerns the general ADU owner-residence condition described by the City. It does not establish that an individual ADU is permitted, inspected, or free from a program agreement, title restriction, or private condition.
The City says long-term rental of an ADU or principal dwelling is permitted with a rental licence. It distinguishes this from short-term rental: the page says short stays are prohibited for either unit, except for specified preexisting cases. If relying on an exception, confirm that the property and any prior licence meet the City’s exact criteria rather than assuming that prior rental activity qualifies.
The City also states that an ADU may not be conveyed or sold separately from the principal dwelling. Review the title and any recorded agreement as well as the municipal guidance; this page is not a title determination.
Before renting or transferring
Check the current Boulder code, ADU permit and inspection record, rental-licence status, and any affordable-unit or other program condition. Confirm whether an alleged short-term-rental exception applies to the unit and its documented history. Review private covenants, HOA or condominium documents, lender restrictions, and insurance terms separately. The City’s public guidance summarizes the local pathway but does not determine an individual property’s status or authorize occupancy without required permits.
