Brandon describes a secondary suite as a self-contained dwelling on the same site as an owner-occupied single-family home. The City identifies attached, garage, and detached suites as permitted types. Its published owner-occupancy policy explains what the permit applicant must provide and when the City reviews the application.

Affidavit and title document

Under the City’s Owner Occupancy Requirement policy, effective August 15, 2013, the property owner or successor signs an owner-occupancy affidavit when applying for a building permit for a secondary suite or boarding house. The application must include a Status of Title issued by the Brandon Land Titles Office no more than 30 days before the application date.

The City may accept the application without a signed affidavit, but a building inspector will not review it until the signed affidavit is submitted. The policy therefore places the proof at the permit-review stage; it is not enough to assume that occupancy will be checked only after construction.

Verify the current procedure

The City’s current secondary-suite page links to the owner-occupancy policy. Because the policy dates to 2013, confirm with Planning, Property & Buildings that the affidavit and title timing remain current before submitting an application.

Key points

  • The City requires owner occupancy for a secondary suite on the same site.
  • The policy places an affidavit and a recent title record in the building-permit application.
  • An unsigned affidavit can pause review even if the City accepts the application.
