San Francisco Planning Code § 207.4 describes a separate-sale route for certain accessory dwelling units approved under the City’s state-mandated ministerial ADU programs. It is not a general right to sell any San Francisco ADU separately from the main residence.

Confirm that the ADU is in a covered approval pathway

The code identifies ADUs approved under specified ministerial programs in § 207.2 or former § 207(c)(6). Before planning a transfer, confirm the unit’s approval path and permit record. A structure’s age, separate entrance, or local ADU label does not establish that it falls within one of the covered programs.

The separate conveyance depends on subdivision approval under the Subdivision Code. The code allows an application to construct an ADU to be submitted at the same time as an application to subdivide the parcel. Filing applications together does not mean that either will be approved, and the code section does not replace the subdivision process or its current conditions.

Verify the current subdivision and title requirements

Check the current Planning Code and Subdivision Code, parcel map or condominium requirements, and any conditions tied to the original ADU approval. Review title, liens, lender consent, easements, shared services, and recorded documents with the responsible City offices and qualified land-registration professionals. The code section provides the eligibility boundary but not a complete checklist or parcel-specific conveyance decision.

Separate-sale eligibility is distinct from building and occupancy approval, rental permission, and private restrictions. Confirm that the unit is lawfully established and that all applicable map, recordation, and title steps are complete before treating it as a separate legal interest.
