Toronto By-law 214-2026 adds special garden-suite rules to Zoning By-law 569-2013 for the odd-numbered municipal addresses from 91 through 209 Parkmount Road and for 160 Mountjoy Avenue. The by-law identifies those lands by their 2024 municipal addresses. It was enacted on March 26, 2026, and states that the added rules apply in addition to Section 150.7. This is a narrow property-specific exception; it does not set Toronto-wide garden-suite standards.
The added dimensional and landscape conditions
For a garden suite on the named lands, the by-law sets a 2.5 m minimum rear-yard setback. The area between the suite and the lot line abutting Craven Road must be landscaped, excluding a permitted driveway. A pedestrian walkway in this area may be no wider than 1.5 m, and at least 75% of the required landscaping must be soft landscaping.
The rear main wall of the garden suite facing Craven Road must contain openings, such as doors or windows, across at least 10% of that wall. If the garden suite is taller than 4.0 m, its main wall must be at least 6.0 m from the main wall of the residential building on the same lot. These requirements describe different parts of the site and should not be combined into one generic setback measurement.
Confirm that the exception matches the property
Before applying these numbers, verify that the current zoning record and legal parcel correspond to the lands named in Exception R 736. Then review the current Section 150.7 rules, lot lines, building walls, permitted driveway, landscaping area, and any other applicable provisions. The exception adds four requirements; it does not replace the underlying garden-suite rules or determine building-code compliance, fire separation, emergency access, or permit approval. For other Toronto properties, use the property’s own zoning provisions rather than carrying these figures across the city.
