Fremont describes an amnesty process for qualifying accessory dwelling units (ADUs) and junior ADUs (JADUs) built without permits before January 1, 2020. The process has an initial health-and-safety inspection stage and a later building-permit stage. Passing or completing the first stage does not itself legalize the unit.

Start with the amnesty request and inspection

The City’s stated starting documents include an amnesty request, a substandard-housing checklist and affidavit, evidence of the construction date, and the City’s invoice. A Building Inspector then conducts the health-and-safety compliance inspection. The City says this stage identifies necessary corrections tied to its checklist. It also states that violations or unconfirmed conditions must be brought into compliance before a permit can be issued. Ask the City which current forms and date evidence it accepts for the specific unit.

After the inspection, Fremont allows an owner to apply for a building permit within five years of the inspection date without penalty, according to its published program description. The five-year period runs from that inspection; it is not a general extension for every older unit. A permit application must include plans that reflect the needed corrections, and applicable fees and further reviews may apply.

Complete the permit route

The unit reaches the end of the process only after the City issues the required permit, the work and corrections are completed, and required inspections are passed. Fremont’s page distinguishes the limited amnesty-stage safety review from the later permit and inspection record. Do not treat the initial inspection as proof of full code compliance, permission to occupy, or completed legalization.

Check Fremont’s current ADU Amnesty Program guidance for the current checklist and application. For an existing property, confirm the construction date, inspection outcome, open violations, permit conditions and final inspection status with the City. Other California cities may use different dates and procedures.
